Terms and Conditions - HAIR BEAUTYS
§ 1 Scope
1.1 The General Terms and Conditions of HAIR BEAUTYS (hereinafter referred to as "AGB") of HAIR BEAUTYS, Am Flohbusch 87, 47802 Krefeld, (hereinafter referred to as "Seller") apply to all contracts - as well as supplements, extensions, and amendments to contracts - between the Seller and end customers (hereinafter referred to as "Customer").
1.2. Separate terms and conditions apply to competitions. Please refer to these in the respective terms and conditions of the current competition.
§ 2 Seller's Offer
2.1 The provider presents services and products from the field of health and beauty (extensions, hairpieces, wigs) on the website operated by them: www.hair-beautys.de.
2.2 The customer can choose between a hairpiece in stock and a custom-made one. The shop entries serve to display the products and provide a detailed product description.
2.3 Stock products:
- Name of the item
- Cap type & size
- Total length
- Hair density
- Color
Stock items are readily available and will be shipped within 1-3 business days after receipt of payment. The seller recommends color and sales consultation via color ring by the seller. For all hairpieces ordered personally in the shop or at HAIR BEAUTYS, there is a 14-day return policy. Custom-made items are excluded from return. The hairpiece must arrive unchanged at HAIR BEAUTYS within the 14 days. No changes are permitted. The right of return expires for altered hairpieces. PayPal fees (approx. €30.00) are excluded from the refund. I reserve the right to charge a processing fee of €50 for returns. These costs are to cover my own expenses for goods receipt inspection, washing, styling, re-listing in the shop, shipping, credit note, refund, and consultation fee. The costs of returning the goods from the customer to me are to be borne by the customer. Return shipping must be done exclusively with insured shipping.
Refund of the purchase price minus the costs within 3-5 days after receipt of the goods.
2.4 Custom-Made Items
A custom-made item is specifically tailored to the customer's request and includes the following contract details:
- Cap type & size
- Hair density
- Hair color
- Hair type
A custom-made item involves prior consultation with the seller and has a delivery time of 6-14 weeks. Returns or exchanges are not accepted.
§ 3 Formation of Contract
Upon payment of the purchase price (at least 50% for custom-made items), a legally binding order is placed. The seller confirms the purchase via email (order confirmation).
§ 4 Costs
4.1 The cost of a hairpiece ranges from €580 to €1400 net (including VAT), with free shipping to customers within Germany. Shipping to other countries requires consultation with the seller.
4.2 Invoicing is done to the address provided by the customer and is sent via email. The goods will be dispatched only after payment (advance payment) of the purchase amount. Shipping takes place 1-3 working days after receipt of payment.
§ 5 Right of Withdrawal
5.1 Consumers generally have a right of withdrawal.
5.2 Further information on the right of withdrawal can be found in the seller's withdrawal policy.
a) Right of Withdrawal You have the right to revoke your contractual declaration within fourteen days without giving reasons in writing (e.g., letter, fax, email). The period begins upon receipt of this instruction in writing, but not before the conclusion of the contract and also not before fulfilling our obligations pursuant to Article 246 § 2 in conjunction with § 1 para. 1 and 2 EGBGB as well as our obligations under §312e para. 1 sentence 1 BGB in conjunction with Article 246 § 3 EGBGB. To meet the withdrawal deadline, it is sufficient to send the withdrawal before the withdrawal period expires. The withdrawal should be addressed to: HAIR BEAUTYS / Katja Gnad, Am Flohbusch 87, 47802 Krefeld or by email to: info@hair-beautys.de.
b) Consequences of Withdrawal For all hairpieces ordered personally in the shop or at HAIR BEAUTYS, there is a 14-day return policy. Custom-made items are excluded from return. The hairpiece must arrive unchanged at the seller within 14 days. No changes are permitted. The right of return expires for altered hairpieces. PayPal fees are excluded from the refund. The seller reserves the right to charge a processing fee of €50 for returns, to cover their own costs for goods receipt inspection, washing, styling, re-listing in the shop, shipping, credit note, refund, and consultation fee. The costs of returning the goods from the customer to the seller are to be borne by the customer. Return shipping must be done exclusively with insured shipping.

c) Special Notes Your right of withdrawal expires prematurely if the service has been fully performed at your explicit request before you have exercised your right of withdrawal. Your right of withdrawal also expires prematurely if it concerns a custom-made item.
§ 6 Seller's Obligations
6.1 The seller is obligated to provide accurate information regarding:
- Cap type & size
- Color
- Length
- Hair density (volume)
§ 7 Copyright
The seller holds the sole copyright and usage rights to all images (§ 4 para. 2 UrhG and as a database according to § 87a UrhG.)
§ 8 Data Protection
Customer data is protected according to GDPR.
§ 9 Miscellaneous
9.1 Changes and additions to these terms and conditions require written form.
9.2 If the service provider/retailer is a merchant, legal entity under public law, or special public fund, Krefeld shall be the exclusive place of jurisdiction for all disputes arising from this contract. The same applies if the customer does not have a general place of jurisdiction in Germany or if their place of residence or habitual abode is not known at the time of filing the complaint.
9.3 The latest version of the terms and conditions is available at www.hair-beautys.de at any time. Changes to the terms and conditions are deemed accepted by the customer if they do not object.
9.4 The seller is authorized to use agents for performance.
9.5 If individual provisions of the contract including these general terms and conditions are or become wholly or partially invalid, this shall not affect the validity of the remaining provisions. The wholly or partially invalid provision shall be replaced by a provision that comes as close as possible to achieving the economic purpose of the invalid provision.
